Estate Planning - which includes but is not limited to trust administration, drafting Wills, Trusts, and designations of a Durable Power of Attorney, Healthcare Surrogate, Preneed Guardian in preparation for long term needs, testamentary devises and estate tax planning. An element of the estate planning process includes discussions with clients regarding their needs in the event of their and/or their spouse’s incapacity.
Probate Administration (Summary, Formal and Ancillary) - which includes testate (with a will) and intestate (without a will) estates.
Elder Law - which includes assisting the elderly or their guardian with planning for long term care and assisting individuals with Medicaid qualification. The Medicaid qualification process involves applying the applicant’s assets and income sources to the established eligibility criteria; and identifying the methods to implement for assisting the applicant in meeting the mandatory qualifications. The methods may include: Transferring assets (does not include preparing or the filing of a gift tax return), Creating a qualified income trust (Miller Trust) Creating an irrevocable trust Creating a personal service contract Drawing equity from property Complete the Medicaid application Review any other documents – hourly rate
Real Estate – which includes closings, landlord tenant related matters, deeds and condominium law.
Small Business – which includes setting up, administration and contractual issues.

FEE POLICY FOR PROJECT COSTS

The Rules of Professional Conduct governing attorneys require that attorneys communicate to the client the basis and rate of the fee charged for legal services. The Rules also recommend that the fee policy be in writing. In addition to providing a clear statement of my fee policy, this written fee policy statement is intended to allow a prospective client an alternative to the normal hourly fee arrangement that is customary in my rendering of legal services (other than modified by this document, my normal hourly fee is included).
